Virginia Crime Classifications

FELONIES

Class 1 Felony– This is the most serious form of felony. It can be punished by death if the defendant was 18 years old or over at the time of committing the offense and if the defendant is not mentally retarded, or it can be punished by a term of life imprisonment, and a possible maximum fine of $100,000.

Class 2 Felony– Punishable by no less than 20 years to a term of life imprisonment, and a possible maximum fine of $100,000.

Class 3 Felony– Punishable by no less than 5 years but not more than 20 years in prison, and a possible maximum fine of $100,000.

Class 4 Felony- Punishable by no less than 2 years but not more than 10 years, and a possible maximum fine of $100,000.

Class 5 Felony– Punishable by not less than one year and no more than 10 years, or in discretion of the jury or the court trying the case without a jury, confinement in jail for not more than 12 months and a fine not to exceed $2,500, either, or both.

Class 6 Felony– Punishable by not less than one year and no more than 5 years, or in discretion of the jury or the court trying the case without a jury, confinement in jail for not more than 12 months and a fine not to exceed $2,500, either, or both.

MISDEMEANORS

Class 1 Misdemeanor– This is the most serious form of misdemeanor.   This crime is punishable by confinement in jail for not more than twelve months and a fine of not more than $2,500, either or both.

Class 2 Misdemeanor– Punishable by confinement in jail for not more than six months and a fine of not more than $1,000, either or both.

Class 3 Misdemeanor– Punishable by a fine of not more than $500.

Class 4 Misdemeanor– Punishable by a fine of not more than $250.
